Terms of Service.

The agreement between you and Stavio — written in plain language.

1. The deal in one paragraph

Stavio is an AI hospitality platform for restaurants. You can use the free tier indefinitely. Paid tiers (Starter, Growth, Pro, Agency) are monthly subscriptions billed via Stripe. You can cancel anytime. We don't sell your data. We don't lock you into long contracts. Be reasonable; we'll be reasonable. The rest of this page is the formal version.

You sign in via email magic link — no password. Keep your email account secure. You're responsible for all actions taken by anyone who accesses your workspace through your email. Notify us immediately if you suspect unauthorized access at hello@stavio.app.

5. What you can do with Stavio

You can use Stavio for any lawful restaurant or hospitality business operation. The service is licensed to you; not sold. Your license is non-exclusive, non-transferable, and lasts as long as your account is active and in good standing.

You own your menu data, service rules, and any content you upload. By uploading, you grant Stavio a worldwide, royalty-free license to host, process, transmit, and display that content for the sole purpose of providing the service. We never use your content for any other purpose. We never sell or share it with marketers.

8. Stavio's content

Stavio owns the platform itself: source code, brand, design, and AI prompts. You may not copy, modify, distribute, or create derivative works of these. The "Verified Badge" embeds we generate for you remain yours to use freely as long as your subscription is active.

9. AI-generated content disclaimer

The chat responses, insights recommendations, and grader scores are generated by AI (Anthropic Claude). AI can make mistakes. For allergen and safety questions, the chat always tells guests to confirm with staff. You are responsible for the accuracy of your menu data — Stavio relays what's in your data, it doesn't independently verify it. Always have staff confirm allergens before serving.

10. Service availability

We aim for 99.5%+ uptime. Stavio is a young, growing service — there may be occasional outages, especially during deploys or third-party (Supabase, Netlify, Anthropic) issues outside our control. We don't offer SLAs at the Free, Starter, or Growth tiers; SLAs are available on Pro and Agency tiers.

11. Termination

By you: cancel anytime via the Stripe portal or by emailing us. Your data is retained for 90 days after cancellation, then deleted (you can request immediate deletion).

By us: we may suspend or terminate accounts for violation of these terms, especially the prohibitions in Section 6. We'll typically warn you first unless the violation is severe or ongoing.

12. Limitation of liability

To the maximum extent permitted by law:

Some jurisdictions don't allow these limitations — in those, our liability is limited to the maximum extent legally permitted.

13. Indemnification

You agree to indemnify and hold harmless Stavio against any claim arising from: (a) your menu content infringing third-party IP, (b) your violation of these Terms, or (c) your misuse of the service.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, USA, without regard to conflict of laws principles. Any dispute will be resolved by binding arbitration in New York, NY, except that either party may seek injunctive relief in court for IP violations.

15. Changes to these terms

We may update these Terms as the service evolves. Material changes will be emailed to active customers and posted at the top of this page with a new "Last updated" date. Continued use after changes means you accept the updated Terms.

17. SMS Program Terms (A2P 10DLC)

Program name: Stavio AI Hospitality Concierge for Restaurants.

Program description: When you text the published phone number for a Stavio-powered restaurant, an AI assistant replies with answers to your questions about hours, menu, allergens, dietary options (including halal, kosher, gluten-free, vegan, and other options), reservations, and parking. Replies are generated based on the restaurant's published information. The program is purely customer-initiated — Stavio does not send marketing, promotional, or unsolicited messages.

Message frequency: Variable, based on the questions you choose to send. A typical exchange is 2–4 messages per inquiry. We do not send recurring scheduled messages.

Message and data rates: Standard message and data rates from your mobile carrier may apply. Stavio does not charge guests for messages.

How to opt out — STOP: Reply STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) at any time to immediately stop receiving SMS replies from the restaurant's number. After replying STOP you will receive one final confirmation message and no further messages until you choose to opt back in.

How to get help — HELP: Reply HELP at any time to receive a help message that includes the restaurant name, contact information, and instructions to stop or resume the service.

How to opt back in: Reply START to resume receiving messages after a previous STOP.

Carriers: Carriers (AT&T, T-Mobile, Verizon, US Cellular, and others) are not liable for delayed or undelivered messages.

Privacy: Phone numbers and conversation transcripts are stored only to provide the AI assistant service and are never sold, rented, or shared with marketers. See our Privacy Policy for details on data collection, retention, and deletion.

Note: This is the v1 of our Terms of Service, written in plain language. The principles won't change as we scale — we'll just expand jurisdiction-specific clauses with outside counsel as we open new markets (Turkey, EU, etc.).
